Terms of Service

These terms govern use of Opsly. By creating an account or using the software you agree to them. If you are agreeing on behalf of a company, you confirm you are authorized to bind that company.

The service

Opsly is a subscription software product for field service companies covering lead capture, customer records, quoting, scheduling, dispatch, time tracking, invoicing, payments and reporting. Features vary by plan. We may add, change or remove features, and will give notice before removing something material to your plan.

Your account

You are responsible for keeping your login credentials secure and for everything done under your account. Tell us promptly if you believe an account has been compromised. Each login belongs to one person and is not to be shared. Plan user limits apply as published on the pricing page.

Your data

Your customer records, messages, photographs, quotes and invoices remain yours. You grant Opsly only the permission needed to host, process, display and back up that content in order to run the service for you. You can export your data at any time while your subscription is active, and you may request a copy for 90 days after cancellation.

Acceptable use

Do not use Opsly to send unlawful, harassing or deceptive messages, to send unsolicited bulk messaging in violation of telecom or anti-spam rules, to store data you have no right to hold, to attempt to access another workspace, or to reverse engineer or resell the software. You are responsible for having the consent required to contact the people you message through Opsly.

AI features

Opsly generates suggested and automatic replies, summaries and lead details using AI. These outputs are drafts produced from your own data and configuration. They can be wrong. You are responsible for what goes out under your company's name, and you can turn automatic replies off or require review at any time in AI Setup. Opsly's assistant is configured never to quote prices, commit to dates or disclose contact details you have not provided, but you remain the final check.

Third party services

Some features depend on outside providers, including Meta for Instagram messaging, telephony providers for calls and texting, and payment processors. Their availability, rules and rate limits are outside our control and can change. If a provider restricts or withdraws access, the affected feature may be limited or discontinued.

Fees and billing

Subscriptions are billed monthly or annually in advance at the rate shown on the pricing page when you subscribe. Payment processing fees for card and ACH transactions are charged by the processor at their rate and are separate from your subscription. Fees are non-refundable except where required by law. We will give at least 30 days notice by email before any price increase affecting your plan.

Cancellation

You may cancel at any time and the service continues to the end of the paid period. We may suspend or terminate an account for non-payment or for breach of these terms, with notice and an opportunity to fix the problem where the circumstances allow.

Availability

We aim to keep Opsly available continuously but do not guarantee uninterrupted service. Maintenance, provider outages and events outside our control can cause downtime.

Warranties and liability

Opsly is provided as is, without warranties of any kind beyond those that cannot legally be excluded. To the maximum extent permitted by law, Opsly is not liable for indirect, incidental or consequential damages, or for lost profits or lost business, and total liability for any claim is limited to the fees you paid in the twelve months before the claim arose.

Changes to these terms

We may update these terms. Material changes will be emailed to account holders before taking effect, and the date above will change. Continuing to use Opsly after that date means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Florida, and any dispute will be brought in the state or federal courts located in Orange County, Florida.
